# How Do I Clear a Retaining Wall Failure to File Violation?

A step-by-step path from a DOB 'failed to file' notice to a cleared record — plus the current penalty amounts, which most websites still get wrong.

Short answer

To clear a retaining wall failure to file violation, hire a Qualified Retaining Wall Inspector, file an acceptable TR16 report, then request a penalty sheet from DOB, pay it and send the receipt. If the wall isn't yours or isn't covered, challenge it with a signed and sealed survey. The penalty is now $5,000 a year.

Key facts

- Failure to file: $5,000 per year; late filing: +$1,000 per month (1 RCNY §103-09, effective Mar 23, 2025).
- DOB issued 2,091 failure-to-file retaining wall violations (code RWNRF) for the Cycle 1 deadline (NYC Open Data).
- Bronx 640, Queens 475, Brooklyn 446, Manhattan 205, Staten Island 147 (NYC Open Data, queried Oct 2026).
- Waivers exist for new owners, bankruptcy and declared emergencies (1 RCNY §103-09(e)).

[NYC Retaining Walls](https://nycretainingwalls.com/) is a licensed and insured retaining wall contractor that repairs walls to the findings of Local Law 37 reports and can connect owners with an independent inspector. A retaining wall failure to file violation means DOB’s records show a wall on your property covered by Local Law 37 — 10 feet or taller at some point and fronting a public right-of-way — with no accepted TR16 report for your borough’s filing window. It doesn’t go away on its own, and since **March 23, 2025** it costs **$5,000 a year**. Our [retaining wall violation repair](https://nycretainingwalls.com/retaining-wall-violation-repair/) page covers the repair side; this guide covers clearing the record.

## How common is this violation?

Very. NYC Open Data’s DOB violations dataset lists **2,091** “failed to file” retaining wall violations (code RWNRF), all tied to the Cycle 1 deadline of December 31, 2018 and issued in 2019, 2022 and 2024. By borough: **Bronx 640, Queens 475, Brooklyn 446, Manhattan 205, Staten Island 147**. Many owners say they never knew they had a covered wall. In 2020, NY1 quoted a Bronx owner: “In 43 years, never has an inspector ever come out to say, ‘There’s a retaining wall and you’re responsible for it.’”

## What does it cost now?

| Penalty | Current rule (from Mar 23, 2025) | Older amount still on DOB’s web page |
| --- | --- | --- |
| Failure to file | $5,000 per year | $1,000 per year |
| Late filing | +$1,000 per month after the window closes | $250 per month |
| Failure to correct an Unsafe wall | $1,000 per month, prorated daily | $1,000 per month |
| SREM uncorrected, later rated Unsafe | $2,000 one-time | — |

## How do you clear it, step by step?

1. **Confirm the violation** in DOB’s Building Information System by address or block and lot.
2. **Hire a Qualified Retaining Wall Inspector** — a New York State-licensed PE with three years of retaining-wall experience. An architect can’t sign a TR16.
3. **File an acceptable TR16 report** within 60 days of the inspection, with the **$355** filing fee. If DOB rejects it, the rule gives you 45 days to revise.
4. **Request a penalty sheet** from DOB, pay it (DOB’s service notice directs payment at 280 Broadway), and email the receipt to the retaining wall unit.
5. **Fix what the report found.** An SREM or Unsafe rating starts its own clock.

## Can you challenge the violation?

Yes, in two situations. **The wall isn’t yours.** If it belongs to a neighbor, the city or a railroad, DOB’s FAQ says to submit a recent signed and sealed survey from a licensed land surveyor with form RWIP-11; DOB doesn’t keep private surveys. Walls backing onto subway cuts are the best-known example — see [walls next to subway tracks](https://nycretainingwalls.com/guide/retaining-wall-next-to-subway-or-railroad/). **The wall isn’t covered.** If no part is 10 feet tall, or it doesn’t front a public right-of-way, a licensed engineer can document that. A third route is a **waiver** under §103-09(e), available for new owners, bankruptcy and declared emergencies. On a lot-line wall, both owners share responsibility; see [shared retaining wall repair](https://nycretainingwalls.com/shared-retaining-walls/).

## What usually comes after the filing?

The report rates the wall Safe, Safe with minor repairs, SREM or Unsafe. An Unsafe rating must be corrected within **90 days**, and an SREM can’t carry into the next cycle — see the [SREM guide](https://nycretainingwalls.com/guide/srem-retaining-wall-rating/). Typical NYC repair bands: minor repairs about $325–$1,600, anchoring a leaning section about $75–$105 per linear foot (Fixr national × RSMeans 129.1). The [cost estimator](https://nycretainingwalls.com/tools/retaining-wall-cost-estimator/) gives a starting number, and our [retaining wall inspection](https://nycretainingwalls.com/retaining-wall-inspection/) page explains how we work alongside your inspector.

## What if you just bought the property?

Violations follow the property, not the person who ignored them. If you bought a house or building with an open failure-to-file violation, the rule’s waiver provision (§103-09(e)) covers new owners, so ask DOB about it when you file — but you still need the TR16. Buyers can avoid the problem entirely by checking BIS for open violations and the retaining-wall flag before closing, and asking the seller for the last TR16 report.

## Which boroughs file next?

Staten Island’s window closes December 31, 2026, Queens files in 2027 and Brooklyn in 2028. If you’re in one of those boroughs, filing on time avoids a fresh violation; see the [Staten Island deadline guide](https://nycretainingwalls.com/guide/staten-island-retaining-wall-inspection-deadline/) and the [Bronx](https://nycretainingwalls.com/service-areas/bronx/) page for the borough with the most Cycle 1 violations.

Bottom line

A failure-to-file violation is cured by filing, not by waiting: get a QRWI out, file the TR16, then settle or challenge the penalty — and fix whatever the report finds before it turns into a second violation. For repairs to your inspector's report, [(718) 555-0100](tel:+17185550100).

## Frequently asked _questions._

**### How do I check the status of my retaining wall violation?**

Search your address or block and lot in DOB's Building Information System (BIS), which lists violations and flags properties with walls covered by Local Law 37. DOB's FAQ also gives an email address for the program, [LL37RetainingWalls@buildings.nyc.gov](mailto:LL37RetainingWalls@buildings.nyc.gov), for questions about a specific filing or violation. Keep copies of everything you file and every receipt.

**### Can the city put a lien on my house over a retaining wall?**

Homeowners have raised this fear, including Bronx owners interviewed by NY1 in 2020. Unpaid city penalties and the cost of emergency work the city performs can follow a property, but we couldn't confirm the exact mechanism for retaining wall penalties. Ask DOB directly or a real-estate attorney before relying on any answer, and don't let a violation sit while you find out.

**### A neighbor filed a DOB complaint about my wall. What happens now?**

A 311 or DOB complaint can lead to an inspection, and an inspection can lead to a violation, so respond rather than wait. Get the wall assessed, keep the area safe if anything is loose, and if the wall is covered by Local Law 37, check that your TR16 is current. Answering early is usually far cheaper than answering a violation.
